Give me a break

Well, the CBC has reported on an interesting development in Canada's Ocean Playground. Apparently one person, defending his property is now under arrested for stabbing one of several people who broke into his home.

The current laws on self-denfence does allow for the use of force in this case as long there was "reasonable apprehension of death or grievous bodily harm from the violence with which the assault was originally made or with which the assailant pursues his purposes."

Given the recent swarming events in Halifax lately, may be the RCMP should investigate before making an arrest...after all, we have one person in a home with multiple intruders...not sure about you, but I think I would have reasonable apprehension of death or grievous bodily harm.

  • I am from Nova Scotia my friend...so I am aware of how nice people are.

    Of course using my logic, if a paper boy walked in I douobt there would be reasonable apprehension of death or grievous bodily harm. Now if the paper boy walk in and started trashing your home, pulled out a gun and started saying how he/she wanted to blow your head off, there would be reasonable apprehension of death or grievous bodily harm.

    By the way, its not my fault you have trouble reading...the report stated:
    Queens RCMP say the 19-year-old man who allegedly stabbed the intruder has been arrested.

    By the way, if he did rob them at some point in the past, they have no right to come into his home. they should have gone to the police. Vigilante justice is not something that should be tolerated. Teh fact is that two wrongs do not make a right. If they have reasons to be angry with this person, it does not give them the right to break into a private home to what, "get him". If that was their motive, then would he not have reasonable apprehension of death or grievous bodily harm?
